
VETERAN TERMS & CONDITIONS

WHEREAS, MedConnectVA LLC (“MedConnectVA”), is in the business of, inter alia, introducing its Clients to Medical Expert(s) (“Expert”), Medical Professionals and/or consultants for anticipated or pending litigation, and WHEREAS MedConnectVA is not a hospital or any other type of health-care provider and WHEREAS, MedConnectVA does not provide its own medical or legal advice of any kind, and WHEREAS MedConnectVA does not warrant or guarantee the opinions set forth by the Medical Experts and Medical Professionals which it refers to its Client(s), and WHEREAS the (“Client”, also called the “Veteran”), whose name is entered below, acknowledges these facts and wishes to engage MedConnectVA to refer Medical Experts and Medical Professionals for the purposes of Medical Record Reviews, Written Nexus Opinions and DBQ’s. WHEREAS services authored by specialized board-certified MDs will be referred to as “MedConnectVA Services”, and services provided at a reduced cost by licensed Physician Assistant Medical Professionals, including but not limited to Nexus Opinions and DBQs, will be referred to as “VetLink Medical Opinions”. WHEREAS MedConnectVA and the Client, hereby enter into this Agreement (“Agreement”).

There are (2) MedConnectVA Service Categories available to Veterans:
*** (1) MedConnectVA Services:
All services are performed by board-certified MDs. A complete, electronic copy of the Veterans Cfile is required. The Veterans CFile must be searchable. Attorney representation is typically required unless the case involves Oncology, in which case, Veterans can be accommodated directly.
MedConnectVA Services include Pre-Screening, Medical Record Reviews, Written Nexus Opinions, and Risk Assessments. See the next sections for FEES and PROCESS. MedConnectVA does not guarantee a successful VA claim by using any MedConnectVA Service.
*** (2) VetLink Medical Opinions
All Services are performed by licensed Physician Assistant Medical Professionals. This service category is offered to Veterans at a reduced cost. The Veteran is responsible for providing an electronic copy of all required medical records.
VetLink Medical Opinion Services include Medical Record Reviews, Nexus Opinions, and DBQs. See the next sections for FEES and PROCESS. MedConnectVA does not guarantee a successful VA claim by using any MedConnectVA Service.
For both Service Categories (MedConnectVA Services & VetLink Medical Opinions), a secure link to upload Medical Records will be provided. All records must be uploaded at one time. Clients cannot upload medical records in pieces.
For both Service Categories (MedConnectVA Services & VetLink Medical Opinions), all medical records are handled in compliance with HIPAA guidelines, including secure medical record storage, records are only shared on a need to know basis with the Medical Professionals and MedConnectVA staff necessary to complete the service, all records are destroyed after the service has been completed and the final work product is delivered to the Client.
For both Service Categories (MedConnectVA Services & VetLink Medical Opinions), all services are completed by human medical experts or medical professionals. There is no AI used to create content for any service.
FEES and PROCESS
The Client agrees to the following Fixed Price “Fee Schedule” for either service Category, MedConnectVA Services and/or VetLink Medical Opinions:

Medical Record Review and Written Nexus Opinion - $2,000
Risk Assessment - $500
There is no charge for Pre-Screening

Mandatory Medical Record Review - $350.
If the case cannot be supported after the Medical Record Review, then the case cannot move forward, and no additional fees are due.
Written Nexus Opinion - $1,150
This fee brings the total cost for Medical Record Review and Written Nexus Opinion to $1,500 $1,500.
VetLink DBQ - $425
*** PROCESS - MedConnectVA Services
Medical Record Review (Cfile) - The Client will be invoiced ($1,000, Invoice 1) for the Medical Record Review when the Cfile has been uploaded into the MedConnectVA Secure Link and the records have been verified for completeness. The case is not released to the Medical Expert until payment for this service has been received by check, credit card or ACH. When the invoice is paid, MedConnectVA will confirm receipt of the payment and will release the Medical Records to the Medical Expert to begin the Medical Record Review.
After the Medical Record Review, if the Medical Expert determines that the case cannot be supported, then the case cannot move forward, and no additional fees are due. The Medical Record Review Fee ($1,000) is non-refundable. If the case can be supported and the Client directs MedConnectVA to move forward with a Nexus Opinion, then:
Written Nexus Opinion - The Client will be invoiced ($1,000, Invoice 2) when the Draft Nexus Opinion is delivered via email. MedConnectVA commits to deliver Nexus Opinions in 30 days or less from the date that the client directed MedConnectVA to move forward with the Nexus Opinion. After the Client has reviewed the Draft Nexus Opinion, a final signed version of the Nexus Opinion cannot be delivered until the invoice is paid by check, credit card or ACH. When the invoice is paid, MedConnectVA will confirm receipt of the payment and then send the final signed version of the Nexus Opinion. The Nexus Opinion Fee ($1,000) is not refundable.
Pre-Screening - The Medical Expert or Medical Professional will review the pre-screening materials including the risk factors identified on the Pre-Screening Request Form and render a preliminary opinion regarding the connection. The preliminary opinion provided during pre-screening is not binding nor is it a guarantee. The complete medical file for a case is not reviewed by the Medical Expert during a no-charge pre-screening. Until a paid full medical record review is conducted, the Expert’s opinion is not definitive. The Expert will not review the full Cfile or other voluminous medical records during a no-charge pre-screening. If the Client prefers definitive answers, the Risk Assessment Service (paid full record review) is recommended.
The Risk Assessment Service includes a thorough, full Cfile record review by our in-house physicians, and it provides definitive answers regarding the service connection (Nexus Question) as defined by the Client.
The fee for a Risk Assessment is $500 and must be paid prior to the beginning of the record review.
To request a Risk Assessment, the Client must complete a MedConnectVA Risk Assessment Request and submit the complete medical file.
All medical records must be provided to MedConnectVA at the start of the Risk Assessment. Additional medical records cannot be submitted after the Risk Assessment Review has begun.
If, after performing a Risk Assessment, it is determined by MedConnectVA that the case be connected, MedConnectVA will honor a full cost credit of the Risk Assessment , to be applied toward a Medical Expert Review and Written Nexus Opinion for 90 days, for the same case and for the same connection. The date the Risk Assessment results are delivered to the Client is the date the 90 days begins.
If, after performing a Risk Assessment, it is determined by MedConnectVA that the case be connected, MedConnectVA will provide the to the Client which will include the specific medical facts detrimental to the case along with medical record page number references.
*** PROCESS - VetLink Medical Opinions
Mandatory Medical Record Review - The Client will be invoiced ($350) for the Medical Record Review when the Medical Records have been uploaded into the MedConnectVA Secure Link and the Medical Professional has been verified for completeness. The case will not be released to the Medical Professional to begin the review until the invoice is paid by check, credit card or ACH.
After the Medical Record Review, if the Medical Professional determines that the case cannot be supported, then the case cannot move forward, and no additional fees are due. The Medical Record Review Fee is non-refundable. If the case can be supported and the Client directs MedConnectVA to move forward with a Nexus Opinion, then:
Written Nexus Opinion - The Client will be invoiced ($1,150) when the Draft Nexus Opinion is delivered via email. MedConnectVA commits to deliver Nexus Opinions in 30 days or less from the date that the client directed MedConnectVA to move forward with the Nexus Opinion. After the Client has reviewed the Draft Nexus Opinion, a final signed version of the Nexus Opinion cannot be delivered until the invoice is paid by check, credit card or ACH. When the invoice is paid, MedConnectVA will confirm receipt of the payment and then send the final signed version of the Nexus Opinion. The Nexus Opinion Fee is not refundable.
DBQ - The Client will be invoiced ($425) when it directs MedConnectVA to begin a DBQ and after all required Medical Records are uploaded to the MedConnectVA Secure Link and have been verified for completeness. The DBQ will not begin until the invoice is paid by check, credit card or ACH. When the invoice is paid, MedConnectVA will confirm receipt of the payment and then release the case to begin the DBQ. MedConnectVA commits to deliver DBQ’s in 30 days or less from the date that the invoice has been paid. The DBQ Fee is not refundable.
GENERAL TERMS
Client understands that the Medical Expert and Medical Professional is an asset of MedConnectVA and that their remarks, reports, and any other written or verbal communication from or with respect to the Medical Expert or Medical Professional is the confidential property of MedConnectVA and cannot be copied or distributed without the written consent of MedConnectVA. The final Nexus Opinion or DBQ that is delivered to the Client, is theirs to provide to the VA or other relevant parties in support of their claim.
Client acknowledges and agrees that MedConnectVA makes no guarantee of a favorable opinion from the VA based on or in conjunction with a written medical opinion or DBQ as commissioned through this Agreement.
MedConnectVA will deliver a draft Nexus Opinion (both MedConnectVA Services and VetLink Medical Opinions) in 30 days or less, starting with the date that the Medical Records are released to the Medical Expert to begin the review.
Upon receiving a completed draft Nexus Opinion, the Client shall review the draft report within (7) days of receiving it, and communicate to MedConnectVA any request for clarification or any change request. MedConnectVA works in good faith with all Clients, Medical Experts, and Medical Professionals to incorporate reasonable edits requested by the Client. The author of the opinion, the Medical Expert or Medical Professional, shall have final decision authority over the content of the Written Nexus Opinion.
The Medical Record Review fee is subject to change if the volume of the medical documents submitted to MedConnectVA for a Medical Expert’s Review is unusually large. This is a rare occurrence and any change in fee would be communicated to the client before the service begins.
EXCLUSIVITY
Client agrees that it shall not directly retain any Medical Expert or Medical Professional provided to Client by MedConnectVA without the knowledge, written consent or involvement of MedConnectVA.
Client agrees not to discuss or negotiate fees with MedConnectVA Medical Experts.
Client agrees that it shall not share Expert identities, or completed opinions or any other written or verbal information regarding the Medical Expert with any party that is unrelated to the case for which the report was written.
While MedConnectVA conducts diligent screening of its Medical Experts, MedConnectVA does not warrant or guarantee the qualifications of Medical Experts and cannot be held liable for any omissions or inaccuracies of Medical Expert credentials or opinions.
SEVERABILITY
MedConnectVA and Client agree that should any part of this Agreement be rendered or declared invalid by a court of competent jurisdiction, the remaining portions of this Agreement shall remain in full force and effect. These Terms & Conditions and the agreed-upon Fee Schedule comprise the entire agreement between MedConnectVA and Client, and they supersede all prior negotiations, agreements, and understandings between and among the parties. This Agreement may only be amended in writing and executed by all parties.
LEGAL VENUE
This Agreement shall be interpreted under the laws of the State of Florida. In the event of litigation relating to the subject matter of this Agreement, Client and MedConnectVA agree that the parties will submit themselves to a mandatory mediation within 90 days of one party’s demand. Such mediation will occur within the state of Florida. Should the parties fail to resolve the disagreement at mediation, any litigation between the parties arising out of this Agreement will be resolved in in Florida Superior Court.
